Welcome to RHYDER (the "App"), a ridesharing platform designed specifically for women. These Terms and Conditions ("Terms") govern your access to and use of the App, the services provided through it, and all related content. By accessing or using the App, you agree to be bound by these Terms. Please read them carefully before using the App. If you do not agree with these Terms, do not access or use the App.

Data Collection: By using the App, you explicitly consent to the collection, processing, and storage of your personal data, including, but not limited to:

  • Identity Information: Name, email address, phone number, profile picture.
  • Contact Information: Address, emergency contact details.
  • Location Data: Real-time location while using the App, pickup and drop-off locations, trip history. This data is crucial for the App's functionality and is used to connect you with drivers, provide accurate ETAs, facilitate navigation, and ensure safety.
  • Ride Information: Trip details, including origin, destination, time, distance, fare, driver rating, passenger rating.
  • Payment Information: Payment method details, transaction history, billing address.
  • Device Information: Device type, operating system, unique device identifiers, IP address.
  • Usage Data: App usage patterns, features used, interactions with the App.
  • Communications Data: In-app messages, notifications, customer support interactions.

We collect this data to:

  • Provide and improve the ridesharing service.
  • Personalize your experience.
  • Ensure safety and security.
  • Facilitate payments and billing.
  • Provide customer support.
  • Comply with legal obligations.
  • Analyze app usage and trends.
  • Communicate with you about service updates and promotions (you can opt out of promotional communications).

We will only collect data that is reasonably necessary for the functionality of the app and the services provided. We will not collect sensitive personal data without your explicit consent.

Location Tracking: The App relies on location tracking to function effectively. You consent to the App accessing and tracking your location while the App is running, both in the foreground and the background (depending on your device settings). You can disable location services on your device, but this will significantly limit the App's functionality and may prevent you from using the service. We use location data solely for the purposes described in this section and will not share it with third parties except as outlined in our Privacy Policy.

Ride Requests: By requesting a ride through the App, you consent to sharing your pickup location, destination, and other relevant trip details with the selected driver. This information is necessary for the driver to accept and complete your ride request.

In-App Communications: You consent to receiving in-app notifications, messages, and other communications related to your rides, account, and service updates. You can manage your notification preferences within the App settings, but disabling certain notifications may affect your ability to receive important information about your rides.

2. User Agreements

Passenger Responsibilities: Passengers agree to:

  • Provide accurate and complete information when creating an account.
  • Provide accurate pickup and drop-off locations.
  • Treat drivers with respect and courtesy, refraining from any verbal or physical abuse, harassment, or discrimination.
  • Adhere to the Community Guidelines (Section 7).
  • Pay for rides promptly using the designated payment method.
  • Refrain from any illegal or inappropriate behavior, including but not limited to consuming alcohol or drugs in the driver's vehicle, damaging the vehicle, or engaging in any form of criminal activity.
  • Be responsible for their own safety and belongings during the ride.
  • Report any issues or concerns to RHYDER promptly.

Driver Responsibilities: Drivers agree to:

  • Maintain a valid driver's license, insurance, and vehicle registration.
  • Provide safe, reliable, and timely transportation.
  • Treat passengers with respect and courtesy, refraining from any verbal or physical abuse, harassment, or discrimination.
  • Adhere to the Community Guidelines (Section 7).
  • Not discriminate against passengers based on any protected characteristic, including but not limited to race, religion, gender, sexual orientation, or disability.
  • Ensure their vehicle is in good working condition, clean, and safe for passengers.
  • Comply with all applicable traffic laws and regulations.
  • Not solicit passengers for rides outside of the App.
  • Maintain the confidentiality of passenger information.
  • Accept ride requests in a timely manner and complete accepted rides unless there is a legitimate reason for cancellation.

Safety Protocols: We are committed to passenger and driver safety. We implement safety features such as in-app emergency buttons, driver verification processes, ride tracking, and the ability to share trip details with trusted contacts. However, we cannot guarantee absolute safety. Passengers and drivers are encouraged to exercise caution, be aware of their surroundings, and report any suspicious activity to RHYDER and the appropriate authorities. We also encourage passengers to verify the driver's identity before entering the vehicle.

Service Limitations: We do not guarantee the availability of rides at all times. Factors such as weather, traffic, driver availability, and special events may affect ride availability. We are not responsible for any delays or cancellations caused by these factors. We also do not guarantee that the App will be error-free or uninterrupted.

3. Liability

Accidents: In the event of an accident, RHYDER is not a transportation provider and does not employ drivers. We act as a technology platform connecting passengers and drivers. We are not liable for any injuries, damages, or losses sustained by passengers or drivers as a result of an accident. The respective driver's insurance will be the primary source of coverage. We will cooperate with investigations by law enforcement and insurance companies.

Misconduct: RHYDER is not liable for the misconduct of drivers or passengers. Any complaints regarding misconduct should be reported through the App, and we will investigate and take appropriate action, which may include suspending or terminating the user's account.

Dispute Resolution: Any disputes between passengers and drivers should be resolved directly between the parties involved. RHYDER may offer mediation assistance but is not obligated to intervene. You agree to release RHYDER from any claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

4. Privacy and Data Protection

We are committed to protecting your privacy. Our Privacy Policy, which is incorporated into these Terms, details how we collect, use, and share your personal data. We comply with all applicable data protection regulations, including [mention specific regulations like GDPR, CCPA, etc.]. We will not sell your personal data to third parties without your explicit consent, except as outlined in our Privacy Policy. We use industry-standard security measures to protect your data from unauthorized access, use, or disclosure.

5. Payment and Cancellation Policies

  • Payment: Passengers are required to pay for rides using the payment method specified in the App. By using the App, you authorize us to charge your chosen payment method for completed rides.
  • Cancellation: Passengers may cancel a ride request before it is accepted by a driver without incurring a cancellation fee. Cancellation fees may apply after a driver has accepted a ride request and is en route to the pickup location. The amount of the cancellation fee will be displayed in the App.
  • Refunds: Refunds may be issued at our discretion for reasons such as technical issues, incorrect fares, or unsatisfactory service. Please contact customer support for refund requests. Refunds will typically be processed within [number] business days.
  • Surge Pricing: During periods of high demand, surge pricing may be in effect. You will be notified of any surge pricing before requesting a ride, and you have the option to accept or decline the higher fare.
  • Penalties: We reserve the right to impose penalties on users who violate these Terms, including account suspension or termination. Penalties may also be applied for fraudulent activity, abuse of the App, or repeated cancellations.

6. Community Guidelines

We are committed to fostering a safe, respectful, and inclusive environment for all users. The following guidelines apply to all users of the App:

  • Treat others with respect and courtesy.
  • Do not engage in any form of harassment, discrimination, or hate speech, whether based on race, religion, gender, sexual orientation, age, disability, or any other protected characteristic.
  • Do not engage in any illegal or inappropriate activity, including but not limited to consuming alcohol or drugs in the driver's vehicle, damaging property, or engaging in any form of criminal activity.
  • Respect the privacy of others.
  • Follow all applicable laws and regulations.
  • Do not solicit passengers or drivers for business outside of the App.
  • Maintain a clean and safe environment in the vehicle.

7. Intellectual Property

All content included in the App, such as text, graphics, logos, images, and software, is the property of RHYDER or its licensors and is protected by copyright laws. You may not use any content from the App without our prior written consent.

8. Disclaimer of Warranties

The App and the services provided through it are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the App will be error-free, uninterrupted, or that any defects will be corrected. We do not warrant the accuracy, completeness, or reliability of any content or information provided through the App. We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, RHYDER shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App or the services provided through it, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or in connection with these Terms shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless RHYDER, its affiliates, officers, directors, employees, and agents from any and all claims, demands, damages, liabilities, and expenses (including attorneys' fees) arising out of or in connection with your use of the App or your breach of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of Arizona, without regard to its conflict of law principles.

12. Dispute Resolution

Any disputes arising out of or in connection with these Terms shall be resolved through, binding arbitration, mediation, or litigation.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be severed and the remaining provisions shall be enforced to the fullest extent permitted by law.

14. Entire Agreement

These Terms constitute the entire agreement between you and RHYDER regarding the App and the services provided through it and supersede all prior agreements and understandings, whether written or oral.

15. Modifications to Terms

We reserve the right to modify these Terms at any time, in our sole discretion. We will post the updated Terms on the App and notify you of any material changes. Your continued use of the App after the posting of the updated Terms constitutes your acceptance of the modified Terms. It is your responsibility to review the Terms periodically for any changes.
